Definitions:
Company’s Right to Decline Work:
The Company reserves the right to refuse or decline work at its discretion. Where the Company agrees to undertake works for the Customer, the Company will use an engineer of its choosing.
2.1 Customer’s Responsibility for Hidden Services:
The Customer must inform the Company of any concealed water, gas, electrical, telephone, or other services prior to the commencement of installation work. The Company will not be liable for damage to such services or consequential losses if not informed.
3.1 Asbestos:
The Customer must notify the Company in writing of any asbestos or asbestos-like materials on the premises. If undisclosed asbestos or suspected asbestos is found, the Company reserves the right to request testing at the Customer’s expense in accordance with the Control of Asbestos Regulations 2006. The Customer must provide an asbestos register where required.
3.2 Obstructions:
It is the Customer’s responsibility to remove any obstructions that may impede the Company’s engineers during the works.
3.3 Flooring and Carpets:
Lifting carpets or flooring may be necessary. While every care is taken, the Company cannot be held responsible for carpets not refitted to their original condition.
3.4 No Redecorating:
The Company will not be responsible for redecorating or plastering. Work areas will be left clean and tidy upon completion.
Charges:
The total charge will consist of the cost of materials supplied and the time spent by the engineer, including any time taken to obtain un-stocked materials, all charged according to the Company’s current rates.
Quotations:
Quotations provided include labour and materials (manifest errors exempted) and are subject to VAT at the prevailing rate.
5.1 Revisions to Quotations:
Quotations may be revised in the following circumstances:
Validity of Quotations:
Quotations are valid for 14 days unless otherwise stated.
Appointments and Attendance:
The Company will make reasonable efforts to ensure the engineer attends on the agreed date and time. However, the Company accepts no liability for non-attendance or delays.
7.1 If the engineer is unable to access the property due to the Customer’s fault, the Company reserves the right to apply a charge of £90 + VAT.
7.2 Works will be conducted during normal working hours, 8:00 AM to 5:00 PM, Monday to Friday, unless otherwise arranged.
7.3 Parking, congestion, or low emission zone charges incurred will be passed onto the Customer.
Oral Quotations:
The Company is not obligated by verbal quotations and will only be bound by written quotes.
Scope of Work:
Prices assume work will be performed according to the agreed proposal. Any deviations, abnormal working conditions, or additional work may incur further charges.
Contract Termination:
Payment Terms:
Payment is due upon receipt of the invoice unless otherwise agreed in writing.
11.1 Interest at 10% per week will be added to overdue payments.
11.3 A deposit may be required 1 week before the start of works.
11.6 The Company reserves the right to withhold certificates until payment is made.
Title of Goods:
Title to goods remains with the Company until full payment is made. The risk passes upon delivery, and the Customer must insure the goods until the title transfers.
Collection of Materials:
Charges may apply for the collection of non-stock materials, depending on time taken and customer notification.
Guarantees and Warranties:
Modification of Terms:
Any amendments to these terms must be in writing and signed by authorised representatives of both parties.
Delays Beyond Control:
The Company is not liable for delays caused by circumstances beyond its control and will have a reasonable extension of time to complete work.
Liability:
The Company is only liable for rectifying its own work and is not responsible for any other damage or claims.
Welfare Facilities:
The Customer must provide access to welfare facilities for the engineers unless otherwise informed.
Use of Photographic Imagery:
The Company reserves the right to use photographs of completed works for marketing. The Customer can opt out by providing written notice.
Jurisdiction:
These terms are governed by Scottish law.
Statutory Rights:
These terms do not affect your statutory rights.
